Your Instructor
Your instructor is a self-employed franchisee of Road Safety Driving School
Lessons
The contract for driving tuition is solely between you and Your Instructor, you and Your Instructors are responsible for agreeing all matters relating to the timing, location and duration of individual lessons.
You must notify Your Instructor of any matters which affect your ability or entitlement to have driving tuition, for example, but not limited to, any lack, or loss, of a valid provisional driving licence.
Road Safety Driving School acts as agent for Your Instructor in receiving Your payments for driving tuition, other than payments made directly by You to Your Instructor, where Road Safety Driving School makes bookings with, or supplies any information or documentation to You, or processes any payments for Your lessons, they act as the agent of Your Instructor.
Cancellations
If you or Your Instructor wish to cancel a lesson a minimum of 48 hours prior notice should be given. Cancellations must be made directly between you and Your Instructors.
If you do not give at least 48 hours notice of cancellation Your Instructor will be entitled to charge for the lesson(s) concerned.
Where a driving test is cancelled due to adverse weather conditions, the DVSA will reschedule the driving test at no cost to the student, however, the full fees due to the driving instructor for driving lessons and the use of the car for the driving test are still payable in full, unless cancelled in accordance with the normal period of notice. The student will not be able to claim these fees back from the DVSA.
When a driving test is cancelled because the student’s documents are not in order, because the student is ill, the student has given incorrect test information or for any other reason that is the responsibility of the student, the driving instructor and Road Safety Driving School are not responsible for the loss of driving test fees. The full fees due to the driving instructor for driving lessons and the use of the car for the driving test are still payable in full, unless cancelled in accordance with the normal period of notice.
Payments and Lesson Bookings
You must pay for tuition in advance by using one of the following methods:
– Payment by cash/cheque direct to your Road Safety Instructor (any cheque must be made payable to the Your Instructor)
Road Safety Driving School has no responsibility to you for payments made by other means and further if you do pay Your Instructor directly by cash or cheque, you should obtain a receipt. Road Safety Driving School accepts no responsibility for any payments made directly to Instructors or as otherwise stated in these Terms and Conditions.
Transferability of Lessons
You cannot sell or transfer lessons which have been purchased in your name to any other person without our consent.
Liability
Your Instructor, Road Safety Driving School and/or Road Safety The Driving School are not liable to You for any loss or damage caused where, and to the extent that:
– there is no breach of a legal duty owned to You by the relevant person or body;
– such loss or damage is not a reasonably foreseeable result of such a breach;
– any such loss or damage, or increase in the same, results from any breach or omission by You;
– any such loss or damage result from circumstances or matters outside of reasonable control of the relevant person or body.
Your Instructor, Road Safety Driving School shall not, in any event, be liable for loses relating to any business interests You may have including, without limitation, lost profits, loss of opportunity or business or business interruption.
Change of Tuition Vehicle
Tuition vehicles are periodically changed, either permanently, when a vehicle is sold, or temporarily, due to mechanical or other problems.
Road Safety Driving School will not be responsible for any losses (e.g. test fees) if the client chooses to decline lessons in the replacement vehicle.
Postponement of Lessons by Road Safety Driving School
Lessons might sometimes need to be postponed at short notice due to illness, mechanical breakdown or some other emergency or unforeseen occurrence, a mutually agreeable alternative appointment will be made.
Every effort will be made to notify the client of the postponement as soon as practicable, however in some circumstances it may be difficult to notify the client in advance of their appointment time.
In all other circumstances Road Safety Driving School will endeavour to keep all appointments, however when it is necessary to alter an appointment a minimum of 48 hours notice will be given.
Lessons in Clients Own Car
All driving lessons are normally conducted in the driving school cars.
On rare occasions tuition may be given in the clients own car, this will only be done if the individual driving instructor is willing to do so, and they may require an initial driving assessment in the dual controlled driving school car before doing so.
The clients car must be legally roadworthy, taxed, insured and mot’d (when necessary)
The clients car must be insured for the use of the driving instructor to give professional driving tuition, and for the driving instructor to drive, this must be confirmed in writing by the clients insurance company.
The use of the clients car is entirely at the clients own risk, and neither the driving instructor nor Road Safety Driving School will be held liable for any damage or accident howsoever caused.
There will be no alteration in fees payable in view of the increased risk and responsibility of giving tuition in a non-dual controlled vehicle.
LEGAL OBLIGATIONS : All pupils must be in possession of a current provisional driving licence, and meet the health and eyesight requirements. You must be able to read (with glasses or contact lenses, if necessary) a car number plate from 20 metres.
APPOINTMENTS: Whilst every care is taken to ensure pupils will receive tuition at the time arranged, and in the vehicle booked for them; All appointments are made on the understanding that Road Safety Driving School accepts no responsibility for lessons postponed due to mechanical breakdown or other circumstances beyond our control. In this event another appointment will be made as soon as possible. Road Safety Driving School has no control over the postponement of driving tests by the Driving and Vehicle Standards Agency (DVSA).
PAYMENT: The first lesson payment is due at the time of booking this ensures we dont double book and the slot is reserved entirely for you, all future lesson payments are due at least 48 hours before lesson commences this gives time for funds to clear, and is not permitted to fall into arrears, payment can be made by bank transfer into our bank account, paym, pay mobile or ping it (Cheques and Cash are no longer accepted)
BLOCK BOOKINGS: A block booking of 4,5,8 or 10 hours must be completed within 4,5,8 or 10 weeks or the remaining hours will be forfeited. (Exceptions will be made for pre arranged holidays)
LESSON CONSISTENCY: To make progress and learning to take place lessons must be consistent, if a break of more than 2 weeks has occurred, I the instructor cannot guarantee a regular slot in my very busy diary
CANCELLATIONS: Cancellations of lessons with less than 72 hours notice will be charged as having taken place and as such charged at full cost. One week notice is required for intensive courses or block Bookings Admin fees apply.
CORONAVIRUS: The main symptoms of coronavirus (COVID-19) are a high temperature, this means you feel hot to touch on your chest or back (you do not need to measure your temperature) a new, continuous cough, this means coughing a lot for more than an hour, or 3 or more coughing episodes in 24 hours (if you usually have a cough, it may be worse than usual) a loss or change to your sense of smell or taste, this means you`ve noticed you cannot smell or taste anything, or things smell or taste different to normal, if you have any of the above you must self-isolate as per Government advice, you will not be able to commence your lessons until you have a negative test result, this must be shown to your Driving Instructor before lessons can commence.
PENALTIES: Whenever you are driving in the school vehicle, you will be under close supervision. However, Road Safety Driving School cannot be held responsible for any infringement of the law. Any fines that are incurred will be the responsibility of the driver.
DRIVING TESTS: Road Safety Driving School reserves the right to with hold the schools vehicle for the driving test if, In the instructors opinion the pupil does not reach the required standard. By going ahead you agreed to the above terms and conditions.
THE DRIVING TEST
a) Driving tests should be booked by you, the learner driver, after you have checked my availability. Driving test bookings will always take priority over other lessons. Therefore, your lesson may be postponed allowing for someone else’s driving test and vice-versa. Any Changes to your lesson bookings because of this you will be notified immediately. I ask that you notified me immediately when a driving test has been booked because my future lessons will have to be scheduled. If advanced notice is not given, then the availability of my vehicle for your driving test cannot be guaranteed and you may need to make alternative arrangements for your driving test.
b) I Use of the vehicle In the Interests of learner drivers and the public’s safety I reserve the right to withhold the use of my vehicle for your driving test, if in my professional opinion as your driving instructor I assess that your driving is or potentially dangerous on the road.
c) Test cancellation
The DVSA requires three clear working days’ notice of cancellation or postponement of your driving test. Failure to provide the required notice will result in the loss of your test fee. I cannot be held responsible for any postponement or cancellation of tests by you or the DVSA for any reason.
